Question:

134 Mr. Durkan asked the Minister for the Environment and Local Government if the driving test section of his Department will issue written confirmation that a driver such as in the case of a person (details supplied) in County Kildare with a disability needs a special car in cases where such a driver fails a driving test due to incapacity; and if he will make a statement on the matter. Persons with a disability that requires them to drive a specially adapted vehicle are invited to indicate this fact on their application for a driving test, and special arrangements are made to facilitate the test. Where a person passes the driving test in an adapted vehicle, the certificate of competency and subsequent driving licence are coded to indicate that the person is limited to driving such a vehicle.

In the case referred to, the person has been advised following an earlier test in a conventional vehicle that one of the reasons for failing this test was inability to operate the controls of this vehicle satisfactorily in all conditions. In such cases, it is a matter for test applicants to consider presenting for a new test in a vehicle which will allow them to drive to the required standard. The person is at present being contacted with a view to arranging a further test.
