Question:

263 Mr. Creed asked the Minister for Agriculture, Food and Rural Development if he will investigate a claim for arable aid from a person (details supplied) in County Cork; and if the case will be reviewed with a view to the maximum possible payment issuing and minimising any penalties in view of the substantial financial penalty and the minor errors involved in this claim. The person named applied for 40.58 hectares under the 1999 arable aid scheme. The 1999 area aid application of the person was selected for inspection. At this inspection it was found that Parcel No. D26504025 was overclaimed by 0.79 hectares. The area found at inspection was 39.79 hectares. This represents a difference of .79 hectares or 1.98% between the area claimed and that found. Under Article 9 of EU Regulations 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied. The applicant was paid on 39.79 hectares under the 1999 arable aid scheme.

Parcel No. D26407026 with a net area of 3.16 hectares was a duplicate claim and was deleted without penalty. No amendment form was received from the person named in relation to parcel No. D26504013. The last day for amendments to 1999 area aid applications was 15 May 1999.
