288 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 special beef premium. [1612/00]

The person named applied for special beef premium in January and May 1999 in respect of nine animals. On his 1999 area aid application he indicated that he was the holder of a milk quota. As yet, my Department has not received details of his milk quota, which are required in order to establish his entitlement to premium. The person named should therefore forward details of his milk quota, certified by his creamery, to my Department as soon as possible.

289 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle headage and premia. [1613/00]

The person named applied on 27 suckler cows under the 1999 suckler cow premium scheme and on 36 beef cows under the 1999 cattle headage scheme on 31 May 1999. On checking the claim in the local office a number of discrepancies were discovered concerning the eligibility of certain animals on both appli cations. The person named was written to on the 31 August 1999 regarding these discrepancies. There was further contact with him but the issues were not resolved and accordingly he was notified on 10 October 1999 that payment would not issue.

The person named called to the local livestock office on 23 November 1999 and requested a review of the decision taken and he subsequently furnished documentation in support of the review. He was informed of the outcome of the review at a meeting on 17 January 2000 and was given a further opportunity to clarify matters and provide supporting documentation. Any response by the person named will be given careful consideration.

290 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo has not received 1999 headage and premia payments. [1614/00]

Overclaims have been identified on one of the land parcels claimed by the person named in his 1999 area aid application. Maps have issued to him and he has been informed of the extent of this overclaim.

In addition the person named also included commonage in his 1999 area aid application, but did not provide proof of his entitlement to claim this commonage. The herdowner has also been contacted in this regard. No payments under the 1999 sheep headage scheme can issue until all these outstanding issues have been resolved. Under the 1999 ewe premium scheme the person named was paid his first instalment of £384.97 on 11 June 1999 and the second instalment of £197.10 on 20 October 1999.

291 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when an appeal for 1999 cattle headage for a person (details supplied) in County Mayo will be finalised. [1616/00]

The appeal lodged by the herdowner concerning his 1999 cattle headage application was fully examined by the headage and premia appeals unit. The herdowner was notified on 18 January 2000 of the outcome to his appeal.

292 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 headage and premia payments. [1617/00]

Payment under the 1999 cattle headage scheme was made to the person named on 19 January 2000. The person named was not an applicant under the 1999 sheep headage scheme.

However, he was paid the first and second advances under the 1999 ewe premium scheme on 11 June 1999 and 20 October 1999, respectively.

294 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1998 and 1999 cattle and sheep headage. [1744/00]

As stated in my reply to Parliamentary Question No. 123 of 14 December 1999, the person named has not responded to queries from the area aid unit in regard to both his 1998 or 1999 area aid applications. No payments can issue until this matter has been satisfactorily resolved.

295 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle and sheep headage. [1745/00]

The person named applied for a total of 83.82 hectares on his 1999 area aid application form. Following processing of his application an area of 83.70 hectares was determined. This represents a difference of 0.12 hectares or less than 0.14 % between the area claimed and that determined. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. In this case therefore no penalty applies. The area on which payments will be calculated is 83.70 hectares. Any payments due will issue as soon as possible.

The person named included commonage in his 1999 area aid application, but did not provide proof of his entitlement to claim this commonage. He has been written to in this regard. No payments can issue until this matter is resolved.

297 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive 1999 cattle and sheep headage and premia. [1747/00]

As stated in my reply to Parliamentary Question No. 179 of 7 December 1999, there were various problems with the 1999 area aid application submitted by the person named. One of the parcels claimed by the person named in his 1999 area aid application overlaps with a parcel of land claimed by another applicant. Both herdowners were written to, with a view to resolving the problem. Both herd owners have now responded, with both claiming the right to the overclaimed and overlapping parcels. Consequently both herdowners have again been contacted requesting them to forward legal proof of their claim, and a response is awaited.

An additional overclaim has also been identified on one of the land parcels claimed by the person named in 1999. Maps issued to him and he had also been informed of the extent of this overclaim. No payments can issue until these matters have been satisfactorily resolved.

Liam Aylward

Question:

298 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development if an early and favourable decision on the appeal by a person (details supplied) in County Kilkenny for suckler cow and headage scheme grants will be arranged in view of the evidence submitted on this case. [1748/00]

The person named applied for 23 suckler cows under the 1999 suckler cow premium scheme and for 23 beef cows under the 1999 beef cow scheme on 26 May 1999. At an on-farm inspection carried out on 30 September 1999 it was established that the person named applied on one animal that was not in his ownership and possession on the date of application. In addition, it was also established that the person named applied on an animal that was deemed to be a heifer and was therefore ineligible for the suckler cow premium scheme or the beef cow scheme. Consequently, the person named was deemed to have made a false declaration through serious negligence which means that under the regulations he has no entitlement to payment under the 1999 suckler cow premium scheme and the 1999 beef cow scheme.

The applicant was notified of the decision by letter on 27 October 1999. The notification letter indicated that it was open to the applicant to have the decision reviewed if he so wished. An application for a review was submitted on 21 December 1999 and is currently under consideration. A decision will issue within the next two weeks.

Ivan Yates

299 Mr. Yates asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Wexford will have a 1999 special beef premium application approved. [1749/00]

The person named applied for special beef premium in respect of 35 animals on 30 March 1999. The application was the subject of a field inspection on 19 October 1999, at which it was found that two of the animals were female but had been registered by the applicant as male. As a result of these findings, the person named was excluded from the scheme for 1999, and was informed of this decision on 11 January 2000. The file has now been passed to a more senior official for review of the decision, and the person named will be informed of the outcome of this review as soon as possible.

Question:

300 Cecilia Keaveney asked the Minister for Agriculture, Food and Rural Development the current position in relation to a 1999 headage grant application for a person (details supplied) in County Donegal; and if he will make a statement on the matter. [1819/00]

The grants due to the person named under the 1999 cattle headage, sheep headage and suckler cow schemes have now been cleared for payment but in accordance with a court order my Department is obliged to issue payments to the ACC.
