Question:

57 Mr. Finucane asked the Minister for the Marine and Natural Resources his views on whether diving for razor clams is acceptable for environmental reasons; if his attention has been drawn to the fact that it is permitted in the United Kingdom; and the plans, if any, he has to issue permits to suitable applicants. [2172/00]

Diving for shellfish is currently prohibited by a by-law under the Fisheries Acts made in 1966.

An amendment of the by-law is under consideration in my Department which would permit the holders of aquaculture licences to dive for shellfish at their own licensed sites. The question of permitting diving for wild stocks will be evaluated in the light of scientific advice on the implications of this fishing method for the stocks concerned, the safety implications which need to be carefully assessed, and in the context of overall strategies for the restoration and development of inshore fisheries generally.
