Question:

121 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason an application under the Newcastle disease legislation for persons (details supplied) in County Tipperary was turned down. [5483/00]

Regulations six and ten of the European Communities (Newcastle Disease) Regulations, 1994, provide for compensation only for the slaughtering of poultry, destruction of carcases or eggs or the destruction, burial or disposal of articles where Newcastle disease, as defined by the directive, has been confirmed. In this case, the presence of Newcastle disease was not confirmed on the premises, no birds were destroyed and consequently the question of compensation did not arise.
