Question:

138 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development the reason no payment under the EU suckler cow scheme has been made to a person (details supplied) in County Kilkenny. [6953/00]

The herd number quoted is not the herd number of the person named nor has this person acquired a herdnumber to date.

The person named applied for premium on 40 animals under the 1998 suckler cow premium scheme on 29 October 1998 and for premium on 59 animals under the 1999 suckler cow premium on the 4 June 1999.

Under the terms and conditions of the suckler cow premium scheme applicants must be registered herd owners to qualify for payments. The person named applied to Erad. on 31 October 1998 to have the herd number in question registered in his name. The Department wrote to the applicant on 11 October 1999 seeking the required information. His suckler cow claims cannot be processed further until the requested information is lodged and considered by the Department.

Question:

139 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive the remainder of a 1999 suckler cow premium. [6954/00]

The applicant submitted 18.04 hectares on his 1999 area aid application. Following processing of his application an area of 16.83 hectares was determined. This represents a difference of 1.21 hectares or 7.19% between the area claimed and that determined. Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied. Therefore, the penalty applied is 2.42 hectares, leaving the area determined at 14.41 hectares.

The person named applied for premium on seven animals under the 1999 suckler cow premium scheme. He was paid an advance of £596.38 in respect of seven cows on 3 November 1999 and was paid a euro top up of £49.63 on 20 December 1999. The remaining balance of £373.10 will be paid shortly.

140 Mr. Yates asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Wexford will be paid beef cow headage payments; and the position on his eligibility. [6971/00]

No applications under the beef cow headage scheme for the years 1993, 1994, 1995, 1996, 1997, 1998 or 1999 have been received from the person named. Under the terms and conditions of the scheme, grants cannot be paid where no application was received. These schemes are now closed for applications.
