Question:

115 Mr. Durkan asked the Minister for Public Enterprise if she proposes to alter any of the regulations governing the allocation of future mobile phone licences; and if she will make a statement on the matter. [9335/00]

I have recently amended the regulations governing the licensing of telecommunications services and systems, including mobile telephone systems, to provide that when an appeal is made against a decision of the Director of Telecommunications Regulation in relation to licensing, the question as to whether the decision of the director stands pending the outcome of the appeal, is henceforth a matter for the court. Up to now, a decision of the director was suspended pending the outcome of the appeal.

I will review all of the legislation on telecommunications in the light of the recent document which I published on policy proposals for the governance and accountability in the regulatory process. This may involve further changes in the decision-making processes for licensing of telecommunications services, including appeals against licensing decisions.
