Question:

94 Mr. Finucane asked the Minister for the Marine and Natural Resources when diving for razor clams will be allowed; and if he will make a statement on the matter. [9847/00]

Diving for razor clams and other shellfish is prohibited by a by-law under the Fisheries Acts made in 1966.

An amendment of the by-law to permit the holders of aquaculture licences to dive for shellfish at their licensed sites is being considered by my Department at present. The question of allowing diving for wild shellfish stocks will have to be addressed, however, by reference to scientific advice on the implications of this fishing method for the stocks concerned, and any decision would have to be made in the context of overall strategies for the conservation and development of inshore fisheries.

My Department is initiating consultations with other relevant bodies and interests on the scientific and other issues which arise on the question of allowing diving for wild shellfish stocks.
