Question:

246 Ms Fitzgerald asked the Minister for Justice, Equality and Law Reform if the case of a person (details supplied) in Dublin 15 was included in the statistics he gave in Dáil Éireann on the Adjournment debate of 6 April 2000 on unprovoked attacks on young men in the Dublin area; the reason for the delay in the emergency response to this case; and if he will make a statement on the matter. [11588/00]

I am informed by the Garda authorities that the attack on the person referred to was included in the statistics for the DMR west division given by me in the adjournment debate on 6 April.

I understand that the response by gardaí is the subject of a complaint to the Garda Síochána Complaints Board, and a superintendent, internal affairs, has been appointed to investigate the matter. The Garda Síochána Complaints Board is the statutory, independent body responsible for the investigation and adjudication of complaints in relation to Garda conduct, and I am sure the Deputy will appreciate that in the circumstances it would not be appropriate for me to make any further comment on the matter at this stage.
