Question:

39 Mr. Gilmore asked the Tánaiste and Minister for Enterprise, Trade and Employment the position in regard to each of the inquiries being carried out by or on behalf of her Department; the progress made in respect of each such inquiry since 9 February 2000; the inquiries in respect of which reports have been referred to the DPP and if she will make a statement on the matter. As anticipated in my reply to the Deputy on 9 February 2000 my Department has since forwarded to the Flood Tribunal a copy of the report of Mr. Gerard Ryan into Ansbacher (Cayman) Limited pursuant to section 21 (as amended) of the Companies Act, 1990.

While progress continues to be made on the company law investigations being undertaken by or on behalf of the Department, the main development in recent weeks has been the High Court Order obtained by the three inspectors to Ansbacher (Cayman) Limited on 6 April 2000 pursuant to section 7(4) of the Companies Act, 1990. This order essentially confirms that there is no impediment to the interview of witnesses by less than the full complement of inspectors.

In relation to the judicial review proceedings of my decision to appoint an authorised officer to Dunnes Stores Ireland Company and Dunnes Stores (ILAC Centre) Limited, the High Court has recently determined following a decision of the Supreme Court that the case will be reheard in the High Court over six days commencing 30 May next.

As previously indicated, the investigation reports of Bula Resources (Holdings) plc., Garuda Limited and National Irish Bank Services Limited are with the Director of Public Prosecutions. I have no information on the intentions of the DPP with respect to any of these reports.
