Vol. 519 No. 7

Written Answers. - Disabled Drivers' Scheme.

Bernard Allen

Question:

79 Mr. Allen asked the Minister for Finance the reason a person (details supplied) in County Cork was refused payments under the Disabled Drivers and Disabled Passengers (Tax Concessions) Regulations, 1994, by the Southern Health Board. [14786/00]

As I have informed the House on a number of occasions, the Revenue Commissioners cannot consider an application for tax relief under the disabled drivers' and disabled passengers' tax concessions scheme unless the applicant is in receipt of a primary medical certificate issued by the senior area medical officer, who is an official of the local health authority.

The Revenue Commissioners have informed me that it would appear that the person named by the Deputy was refused the issue of such certificate by the appropriate senior area medical officer. I am also informed that the Disabled Drivers' Medical Board of Appeal has no record of an appeal by the person against the refusal to issue the required certificate. I would advise the person concerned to make the appeal to the board as soon as possible. This board is an independent body whose decision is final; I have no powers which would allow me to overturn a decision of the board.
