Question:

105 Mr. McGuinness asked the Minister for Finance the progress if any, made in dealing with complaints relating to drainage of a person (details supplied) in County Kilkenny; if an official will visit this person to bring this problem to a speedy resolution while at the same time acknowledging his property rights. Officials of the Office of Public Works and-or their representatives, have been in communication with the individual concerned in County Kilkenny by telephone, letter and in person on a number of occasions in relation to his various complaints about the proposed interference with his business premises under the Nore River, Kilkenny city, drainage scheme. Indeed, their valuer met him with his legal representative some time ago and discussed courses of action which are open to him arising from the proposed scheme works on his premises. If the person still feels that there are legal matters, which require clarification, he might usefully consult his own legal adviser or have his solicitor contact the Office of Public Works on his behalf.

The commissioners, who are in the process of finalising the detailed design for the overall scheme, will continue to liaise with this person during the course of their scheme works in relation to various aspects of the works proposed for his premises. In that regard, their consulting engineer will call to the individual when he is next in Kilkenny in mid-June.
