Question:

68 Mr. Yates asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) in County Wexford will have his level of REPS penalty reviewed and reduced in view of the circumstances relating to the case; and if an appeal determination has been given in this case. [15949/00]

A REPS compliance check was carried out by my Department on the person named in February 1999. It was found that two requirements contained in the applicant's agri-environmental plan had not been carried out and as a result, penalties amounting to 60% were imposed, these penalties being the appropriate ones specified in the scheme conditions.

The penalties were appealed by the person named and were reviewed by my Department's REPS appeal committee in August 1999. The appeal committee considered the matter and took account of the applicant's appeal and all other relevant documentation but found that it had no option but to uphold the penalties originally applied. The decision of the appeal committee is the Department's final position on penalties imposed under the scheme.
