Merchant Shipping (Investigation of Marine Casualties) Bill, 1999: From the Seanad.

The Dáil went into Committee to consider an amendment from the Seanad.
Seanad amendment No. 1:
In page 15, subsection (4), line 17, ", impede or improperly" deleted and "or impede or improperly to" substituted.

When this amendment was proposed on Committee Stage, both the parliamentary draftsman and the Attorney General's office advised that it is not necessary because it adds nothing to the meaning or interpretation of the provision which already exists. On reflection, however, the Attorney General's office has acknowledged that there may be an argument that the amended wording is more correct than a strictly grammatical point of view and avoids a split infinitive, but this has no bearing on the ordinary meaning of the section. To avoid any doubts, however, and in order to ensure that proper grammatical rules are complied with, I agreed to accept the amendment when it was put forward in the Seanad. I recommend that the Dáil accept it also.
