61 Mr. Healy-Rae asked the Minister for the Marine and Natural Resources if he will direct the South-Western Regional Fisheries Board to allow a person (details supplied) in County Kerry immediate permission to remove the heaps of gravel in the Inny River which is running through his land and which is causing all kinds of damage to his property; and if he will make a statement on the matter. Under the Fisheries Acts, the South-Western Regional Fisheries Board has responsibility for the protection, conservation and development of fisheries in its fisheries region which includes the area referred to by the Deputy. The board informs me that it has written to the Deputy in recent days on this matter. The board has explained that the landowner does not require the permission of the board to remove the gravel, however, it does draw attention to the obligation on the landowner to comply with the law in whatever he may choose to do. There are, for example, circumstances where planning per mission may be necessary and, in addition, the person must not injure or disturb any fish spawning bed or any bank or shallow where the spawn or fry of salmon, trout or eels may be.
