396 Mr. McGuinness asked the Minister for Agriculture, Food and Rural Development if he will review the case of a person (details supplied) in County Kilkenny with a view to paying all subsidies which have been withheld from him over the last two years; the reason this has happened; the reason registered letters sent to the Department regarding the case are not on his file; and if he will make a statement on the matter. The herdowner lodged an appeal on 7 June 2000 concerning his 1998 area aid application and his appeal is currently being examined. A penalty was imposed in this case because it was found that an intentional false declaration was made by the herdowner in listing ineligible lands on his application.

All aspects of the herdowner's appeal will be examined by the headage and premia appeals unit and the herdowner will be notified of the outcome as soon as possible.
