Question:

230 Mr. Creed asked the Tánaiste and Minister for Enterprise, Trade and Employment if persons (details supplied) who had their employment transferred from one company to another, which share a number of the same directors and who did not receive any redundancy prior to the transfer, will have any future redundancies calculated on the basis of their employment record at both companies collectively; and if she will make a statement on the matter. I assure the Deputy that in a situation where there is a change of ownership from one company to another, with no break in employment and where a redundancy payment has not been made, the continuity of employment is preserved for the purposes of statutory redundancy payments in the event of the employee subsequently being made redundant by the new employer.

Provided that all the employees referred to in the Deputy's question fulfil these criteria, any future redundancies will be calculated on total reckonable service in employment with both companies.
