Question:

235 Mr. Haughey asked the Tánaiste and Minister for Enterprise, Trade and Employment the position regarding an application by a person (details supplied) in Dublin 5 for a pension under the Hospitals' Trust (1940) Limited (Payments to Former Employees) Act 2000; if this claim can be adjudicated on within the scope of the Act; if she has any discretion in this regard; and if she will make a statement on the matter. The Hospitals' Trust (1940) Limited (Payments to Former Employees) Act, 2000, does not allow for the payment of pensions to former employees of the company. It allows for payment of a lump sum of £20,000 each to certain former employees who had been employed in the company for a period of not less than two years which was a period of continuous employment and continued to be so employed on 1 November 1986 or later.

With regard to the person concerned, the committee established under the Act has reviewed his application. The committee has found that his application is ineligible for the payment because it does not meet these requirements and, in par ticular, it does not meet the requirement of being employed by Hospitals' Trust (1940) Limited on 1 November 1986 or later. In the circumstances, his application has been refused.
The Act provides that any refusal may be appealed within 21 days of the receipt by him of the notification.
