Question:

384 Mr. Sargent asked the Minister for Finance if he will detail, from the time of the present Dáil, the financial penalties imposed on the Government resulting from the failure of his Department to comply with EU directives; and the legal proceedings that are now pending by the EU as a result of the failure of his Department to comply with EU directives. [24138/00]

The following financial penalties have been imposed since I took office.

In the case of the recently decided European Court of Justice decision, Commission v. Ireland, and a number of other states, concerning the imposition of VAT on toll roads, certain costs will arise, including possible arrears of own resources paid to the EU in accordance with the terms of the judgment. This is at present being assessed. Legal costs for both Ireland and the EU Commission at rates still to be determined also arise in relation to this case.
