Question:

749 Mr. Sheehan asked the Minister for Social, Community and Family Affairs when a person (details supplied) in County Cork will receive an oral hearing on her carer's allowance appeal. [24666/00]

The person's application for carer's allowance was disallowed by a deciding officer on the grounds that she did not satisfy the statutory condition of providing full-time care and attention for the relevant person.

The person concerned has now appealed this decision to the social welfare appeals office. A submission on the case is being prepared by the deciding officer and will be sent to the social welfare appeals office. The case will then be referred to an appeals officer for consideration.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
