Question:

107 Mr. Durkan asked the Minister for Justice, Equality and Law Reform the current position in regard to processing of an application for refugee status in the case of a person (details supplied) in County Kildare who is resident here for more than one year with his wife and children; if he will clarify the status of his current residency; his availability for work; and if he will make a statement on the matter. [26211/00]

The person referred to withdrew his application for asylum in May of this year and lodged an application for residency based on his parentage of Irish citizen children. He has since been interviewed in connection with this application and my Department will shortly be in contact with him again in this regard. In the event that his application is successful he will be entitled to work in Ireland without a work permit for the duration of his permission to remain.
