Question:

73 Mr. Creed asked the Minister for Agriculture, Food and Rural Development when a decision will be made on the appeal by a person (details supplied) in County Cork for suckler premium. [28045/00]

The person named made an application for premium on 34 suckler cows and five heifers under the 2000 suckler cow premium scheme on 31 May 2000.

It has emerged that one of the cows applied on was disposed of on 3 August 2000 which is within the six month retention period contrary to the terms and conditions of the scheme. Consequently, in accordance with the regulations, the animal in question was rejected with a reduction penalty of 2.63% on the remaining 38 animals on the claim. The person named was notified of the decision on 3 November 2000.

An appeal was lodged on 14 November 2000. This appeal is under consideration at present and the applicant will be contacted by my Department within the next week regarding issues raised in the appeal.

Question:

74 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive cattle headage and suckler cow premium for 2000. [28108/00]

One of the parcels claimed by the person named in his 2000 area aid application overlaps with a parcel of land claimed by another applicant. Both herd owners have been written to with a view to resolving the problem and a response is awaited. No payments can issue until the matter has been resolved.
