Question:

210 Mr. Howlin asked the Minister for Justice, Equality and Law Reform if he will defer the execution of the decision made on the application for leave to remain here on humanitarian grounds of a Nigerian national (details supplied) to enable her to complete her Bachelor of Arts degree course at the National College of Ireland and to graduate in June 2001; and if he will make a statement on the matter. I made a deportation order on 27 July, 2000 in respect of the person concerned under section 3 of the Immigration Act, 1999. Representations were made on behalf of the person and these and other factors were considered, as required by section 3 of that Act, in reaching the decision to make the deportation order.

I understand that the person's legal representatives have notified my Department of their intention to institute judicial review proceedings. In accordance with normal procedures, my Department has given an undertaking not to proceed with the enforcement of the deportation order pending formal application to the high court for leave to apply for judicial review. Such application must be made in accordance with the relevant provisions and deadlines in the Illegal Immigrants (Trafficking) Act, 2000.
