Question:

353 Mr. J. Higgins asked the Minister for Agriculture, Food and Rural Development the reason for the delay in a headage payment to a person (details supplied) in County Mayo. [30539/00]

A herdowner must submit a valid area aid application for the relevant year in order to be considered for payment of headage grants. No area aid application was received from the person named for 2000, and consequently no area aid related payments can be made for that year.

355 Mr. M. Moynihan asked the Minister for Agriculture, Food and Rural Development when outstanding payments will be made to a person (details supplied) in County Cork. [30574/00]

The person named submitted a 1999 area aid application on which they declared a total of 31.84 hectares of forage area and 5.30 hectares of arable land. However, a part of one of the parcels claimed on this application was also claimed by another applicant. This matter was resolved in favour of the other applicant on the basis of maps supplied to my Department. An over claim was therefore established in respect of the area claimed by the persons named.

Under Article 9 of EU Regulations 3887/92, no penalty is applied when the difference is less than 3%, the penalty is based on double the difference when it is between 3% and 20% and when the difference is over 20%, a 100% penalty must be applied.
Therefore in this case the penalty is based on a difference of between 3% and 20%. A penalty of 2.94 hectares has to be applied leaving the area determined for payment at 28.90 hectares of forage and 5.30 hectares of arable.
Extensification premium is payable on all animals paid under the suckler cow and special beef premium schemes if the stocking density on the holding is less than 1.40 livestock units per hectare. The stocking density for the persons named based on a forage area of 28.90 hectares is 1.48 lus/ha. As the stocking density on the holding is not less than 1.40 lus/ha the persons named have no entitlement to 1999 extensification premium. Payments amounting to £2,645.04 have been made under the special beef premium scheme and £1,379.06 under the arable aid scheme.

Question:

356 Mr. M. Moynihan asked the Minister for Agriculture, Food and Rural Development when outstanding beef premium payments will be made to a person (details supplied) in County Cork. [30575/00]

The person named made the following applications for special beef-bull premium: 27 animals on 12 January 2000; 25 animals on 19 January 2000; one animal on 18 February 2000; one animal on 14 July 2000.

The first application was the subject of an on farm inspection. At the inspection it was discovered that 11 animals were disposed of within the two month retention period. These 11 animals were rejected from the application. As the number of rejected animals exceeded 20% of the number of eligible animals, the applicant was not entitled to payment in respect of the 27 animals listed on this application. The person named was informed of this decision and of his right to appeal to the district inspector. To date no record of an appeal has been received.

Payment totalling £2075.32 representing 80% of the total due has issued in respect of the 27 animals listed on the remaining three applications of the person named. The final 20% balancing payment due will issue shortly.
