Question:

765 Mr. Callely asked the Minister for the Environment and Local Government the number of days the Flood tribunal has sat to date; the total costs associated with the tribunal to date; the names of each legal team; and the proportion of costs paid to date which is attributable to each member of the legal team. [30589/00]

The number of days the Flood tribunal has sat in public to 26 January 2001 is 243. The cost of the tribunal to the 26 January 2001 is £9,644,877.15. The chairman of the tribunal, Mr Justice Flood, has granted limited representation to a number of parties at the public sittings of the tribunal. A list of these parties, as provided by the tribunal, is set out in table A below. It should be noted that there are a number of parties who have appeared at the tribunal with representation but have not been granted limited representation by the sole member.

No costs have been awarded to any member of any legal team. The tribunal has stated that in cases where representation is granted it does not imply any guarantee that costs will be awarded to the person to whom representation was granted. In addition, the tribunal has clearly indicated that, save in exceptional circumstances, where the tribunal decides to make an order granting costs to a person, the tribunal will only certify the costs of one solicitor, one junior counsel and one senior counsel.

A list of the members of the Flood tribunal's legal team is set out in table B below, including the payments made to each individual to 26 January 2001. The payments are inclusive of VAT but exclusive of with-holding tax which has been deducted at the appropriate rate.
