768 Mr. R. Bruton asked the Minister for the Environment and Local Government when he will bring into force sections of the Local Government and Planning Development Act, 2000, which deal with planning provisions in respect of proposals to reclaim land for development purposes, such as has been proposed by the Dublin Port Company; and if he will make a statement on the matter. 774 Mr. Haughey asked the Minister for the Environment and Local Government when the sections of the Local Government Planning and Development Act, 2000, which deals with a planning application for land to be reclaimed following an application for a foreshore licence, will be brought into effect; and if he will make a statement on the matter. Bruton asked the Minister for the Environment and Local Government if he has brought into force the sections of the Planning Act, 2000, which provide that any applications to carry out land reclamation beyond the foreshore would in future require planning permission; if not, when he will bring these sections into operation; and if his attention has been drawn to the fact that Dublin Port Company has published material from its environmental impact statement which does not take into account the new legislation which the Oireachtas has passed; and if he will make a statement on the matter. 857 Ms Fitzgerald asked the Minister for the Environment and Local Government when the provisions of the Planning and Development Act, 2000, will be signed into operation; the outstanding provisions in this regard; and if he will make a statement on the matter. [2333/01]

I propose to take Questions Nos. 768, 774, 783, 813 and 857 together.

The Planning and Development Act, 2000, was enacted on 28 August 2000. In view of the scale and complexity of the provisions of the Act, and the need to make regulations to give full effect to its provisions, it is necessary to commence the Act in stages. To date, I have made two commencement orders bringing a number of Parts of the Act into force on 1 November 2000 and 1 January 2001. These include Part II on development plans, Part V on the supply of housing, Part IX on strategic development zones, Part XIV on the acquisition of land and Part XX which amends the Roads Act, 1993. Regulations are currently being prepared by my Department which will enable me to bring the development control provisions of the Act (including the provisions in Part XV concerning development on the foreshore) into force. Some of these regulations require the prior approval of both Houses of the Oireachtas and I propose to submit draft regulations for approval before the end of March. In addition to the requirements of the Planning and Development Act, 2000, development on the foreshore is subject to the requirements of the Foreshore Acts, 1933 to 1998, which are a matter for my colleague, the Minister for the Marine and Natural Resources.
