Question:

792 Mr. J. Bruton asked the Minister for the Environment and Local Government if, further to Parliamentary Question No. 259 of 8 November 2000 concerning complaints to the European Union under environment directives in respect of development consent for a gas powered plant at Platin, County Meath, and against a proposed cement works at Kinnegad, County Meath, he will state by whom the complaint was lodged; the nature of the complaint; if the complaint is inhibiting work; and the length of time he expects the complaint to take before it is decided. Both complaints to the European Commission allege a failure to fully satisfy the terms of Council Directive 85/337/EEC (as amended) on the assessment of the effects of certain public and private projects on the environment. To assist the preparation of a response to the Commission, my Department has sought and obtained reports from the planning authority and An Bord Pleanála and a response will issue shortly. At that stage, a decision on the complaints will be a matter for the EU Commission. It is not Commission practice to reveal the identity of complainants to member states. The question of whether or not to proceed to implement a planning permission is a matter for the developer and is not something on which the Department would have information.
