851 Mr. Ring asked the Minister for the Environment and Local Government if he has satisfied himself with the way in which regulations are being used regarding headlights on vehicles; and if he will make a statement on the matter. [2182/01]

852 Mr. Ring asked the Minister for the Environment and Local Government his views on whether powerful headlights are within the regulations; if he will outline the regulations regarding headlights; and the way in which they are enforced. [2183/01]

I propose to take Questions Nos. 851 and 852 together.

The relevant regulations require that every lamp must be fitted and constructed so that it will not dazzle or mislead other traffic when lit. In addition, headlamps must be fitted with a dipping device such that the beam of light from the headlamp, when dipped, is incapable of dazzling a person more than 25 feet away from the lamp and in a specified position, which approximates to that the driver of an oncoming vehicle. Dipped headlamps must be used when a vehicle is either passing another vehicle or travelling close behind one. Within this framework a maximum power rating is not specified for vehicle headlamps.

Checks on headlamp condition and alignment are carried out as part of both the national car test and commercial vehicle testing scheme.

Enforcement of the regulations is the responsibility of the gardaí.
