Question:

138 Mr. Durkan asked the Minister for Foreign Affairs the status of the European Charter of Fundamental Human Rights post-Nice; and if he will make a statement on the matter. [2148/01]

At the Nice European Council on 7 to 9 December 2000 the Council, with the European Parliament and the Commission, proclaimed the European Charter of Fundamental Rights. In accordance with the conclusions of the Cologne European Council in June 1999, the question of the charter's force will be considered later.

Incorporation of the Charter of Fundamental Rights in the treaty has been suggested by a number of partners but no formal proposals have been made in relation to the timetable for considering such a proposition. The charter, therefore, remains a political declaration.
