Question:

136 Mr. Callely asked the Minister for Justice, Equality and Law Reform further to Parliamentary Question No. 123 of 27 May 1999, the progress of the criminal investigation taking place in an institution (details supplied) under the aegis of his Department; and if he will make a statement on the matter. [1463/01]

I am informed by the Garda authorities that an investigation was carried out in April 1999 into allegations of sexual assault and rape by a member of staff at the institution in question which, incidentally, is not under the aegis of my Department. I understand that a total of nine patients alleged that these offences had occurred over a period of 18 months. The staff member accused of these offences was arrested on 2 May 1999 and again on 12 October 1999. I understand that this person denied all allegations. I am further informed that a file on this matter was forwarded to the DPP, who directed that no prosecution should take place and I understand that a health board investigation is under way into the matter.
