Question:

47 Mr. Higgins (Mayo) asked the Minister for Justice, Equality and Law Reform if investigations have been conducted into allegations made by a person (details supplied) concerning the conduct of gardaí relating to the raid on licensed premises; if he will explain the circumstances surrounding the State not contesting the appeal brought by this person against his conviction and sentence to three years' imprisonment on 1 March 1995; and if he will make a statement on the matter. The case is currently before the Court of Criminal Appeal and, as such, the Deputy will appreciate that I am constrained from making any detailed comment in the matter. I can state, however, that I have been informed by the Garda Authorities that allegations pertinent to the prosecution of the person referred to by the Deputy were included within the scope of the investigation carried out by an assistant com missioner into allegations of corruption and malpractice involving members of the Garda in County Donegal.

A file was subsequently forwarded to the Director of Public Prosecutions whose directions are awaited. The matter raised by the Deputy will be reviewed once the directions of the DPP have been received.
