145 Ms Cooper-Flynn asked the Minister for Arts, Heritage Gaeltacht and the Islands if a person (details supplied) in County Mayo is entitled to any compensation as he was effectively put out of business when land in his area was designated as a special area of conservation. [4312/01]

Any owner of property rights in or over lands in special areas of conservation that are the subject of turfcutting restrictions is entitled to compensation for actual financial losses arising from the restrictions on the use of those rights. Entitlement to this compensation in respect of commercial operations is established by providing to my Department proof of ownership, vouched income, receipts and audited accounts. A tax clearance certificate must also be made available for inspection. My Department currently has no application from, or on behalf of, the named person for compensation.
