Question:

26 Mr. U. Burke asked the Minister for Arts, Heritage Gaeltacht and the Islands if she is satisfied with the transposition into Irish law, by way of Ministerial order, of the Habitats Directive having regard to the provisions in the Constitution on property rights; and if she will make a statement on the matter. [4876/01]

With regard to the constitutionality of the EC (Natural Habitats) Regulations, I assure the Deputy that these regulations were drafted in close consultation with the Office of the Attorney General and the office of the Chief Parliamentary Counsel to the Government office. I am satisfied the transposition of the directive into Irish law by way of regulations is constitutional.
