Question:

97 Mr. Kenneally asked the Minister for Health and Children the outcome of any investigation he may have carried out in respect of a person (details supplied) in County Waterford referring to problems which were outlined to his predecessor as Minister on 9 August 2000; and if he will make a statement on the matter. [5066/01]

I have been advised by the South Eastern Health Board that the person concerned, as a general medical services scheme patient, has a right to his medical records which are in the possession of the doctor concerned by reference to section 6.9 of the Freedom of Information Act, 1997.

The board has also advised that in order to assist this person in making progress on his case, he should write, quoting the Freedom of Information Act, to the chief executive officer of the South Eastern Health Board, setting out the records he wants and the reasons for decisions which have affected him. The South Eastern Health Board has agreed protocols for transferring freedom of information requests, where necessary, to other bodies and will link with the Southern Health Board in this regard.
