Question:

96 Mr. Crawford asked the Tánaiste and Minister for Enterprise, Trade and Employment the situation with regard to an employer who employs foreign workers (details supplied) under a work permit; if the employer is entitled to a refund of the payment with regard to the work permit when they leave their employment without giving any reason; if the employer is obliged to cancel the permit since they did not terminate the employment; and if she will make a statement on the matter. The fee charged by my Department to an employer for handling an application for a work permit to employ a non-EEA national is an administrative one and is not refundable once the permit has issued to the employer concerned.

If the non-national in respect of whom the permit has been issued subsequently leaves the employment of the employer concerned for any reason, the employer is obliged to return the work permit concerned to the Department. This is clearly stated on each work permit which is issued. This procedure is necessary for immigration control purposes.
