Vol. 532 No. 4

Written Answers. - Occupiers' Liability.

Michael Creed

Question:

563 Mr. Creed asked the Minister for Justice, Equality and Law Reform if he has satisfied himself with the operation of the current legislation on occupiers' liability; if his Department proposes to introduce any legislative changes in this area; and if he will make a statement on the matter. [8246/01]

The Occupiers' Liability Act, 1995 simplifies and clarifies the law on occupiers liability. It outlines a duty of care an occupier of a premises has towards three classes of entrant – visitors, recreational users and trespassers and it implements many of the recommendations in the Law Reform Commission's final report on the subject.

While I have no proposals to change the law in this area, my Department will continue to keep it under review.
