Question:

356 Ms O. Mitchell asked the Minister for Justice, Equality and Law Reform the action which can be taken against drivers of cars registered in Northern Ireland driving on roads in the Republic without insurance and who are involved in traffic accidents. [9439/01]

I am informed by the Garda authorities that where a vehicle which is registered in Northern Ireland is involved in a traffic accident in the Republic the vehicle is covered by the European Communities (Road Traffic) (Compulsory Insurance) Regulations, 1975. I understand that this means that the settlement of claims in respect of accidents is guaranteed even when the vehicle is not insured. As the Deputy will appreciate, questions relating to the above legislation are matters for the Minister for the Environment and Local Government who is responsible for all road traffic legislation. I am informed that where the Garda decides to prosecute for no insurance, the mutual assistance programme provides for the service of summonses outside the jurisdiction.
