Question:

362 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 541 of 20 March 2001, he will detail the findings and recommendations arising from the investigation of an assistant garda commissioner, referred to in the original question; and if he will make a statement on the matter. I am informed by the Garda authorities that the investigation to which the Deputy refers pursued every possible line of inquiry and that all of the resulting evidence was contained in the Garda file submitted to the Director of Public Prosecutions. As the Deputy is aware, the director decided that no prosecution should be taken. The Deputy will appreciate that evidence gathered in the course of a Garda investigation is highly confidential, and I do not propose to comment further on this aspect of the case.

363 Mr. Gregory asked the Minister for Justice, Equality and Law Reform if, further to Parliamentary Question No. 66 of 5 October 2000, he will detail the specific findings and recommendations arising from the probative inquiry carried out by an assistant garda commissioner; and if he will make a statement on the matter. [9487/01]

I am informed by the Garda authorities that the probative inquiry carried out by an assistant commissioner established that the person in question was lawfully arrested and lawfully detained under the provisions of section 4 of the Criminal Justice Act, 1984, in connection with the double murder at Grangegorman. I am also informed that it was further established that the regulations as contained in the Treatment of Persons in Custody, in Garda Síochána Stations, Regulations, 1987, were complied with in full in respect of the person in question.
