Question:

138 Mr. Callely asked the Minister for Health and Children the way in which the proposed enterprise liability scheme will cover doctors; if it will cover public work only; and if he will make a statement on the matter. [7868/01]

The proposals at present being discussed with health service agencies and the medical profession envisage that the proposed enterprise liability system will cover claims against doctors and other health professionals in respect of their work within the public health system. This will include claims arising from private patients treated in a public hospital. The detailed implementation of these proposals is still a matter for discussion with all of the interested parties.
