Question:

142 Mr. Callely asked the Minister for Health and Children the progress which has been made on the issue of litigation against tobacco companies and if he will make a statement on the matter. [7877/01]

I presume the Deputy is referring to the possi bility of the State initiating litigation against the tobacco industry, to recoup the costs incurred in treating tobacco related illness. This issue has been referred for legal advice. Given the complexity of the substantive law issues involved, it is not possible to indicate, at this stage, when the matter will be finalised.
