80 Mr. Higgins (Mayo) asked the Minister for Health and Children if he will overrule the decision by the Western Health Board not to grant a licence for a community pharmacy for Knock, County Mayo; and if he will make a statement on the matter. [9343/01]

92 Mr. Higgins (Mayo) asked the Minister for Health and Children the reason for the ongoing refusal to approve a community pharmacy for Knock, County Mayo; and if he will make a statement on the matter. [9344/01]

I propose to take Questions Nos. 80 and 92 together.

The Health (Community Pharmacy Contractor Agreement) Regulations, 1996, specify the criteria to be used by a chief executive officer of a health board when determining applications for community pharmacy contractor agreements. As you are aware, appeals have been received under article 10 of the regulations in regard to the decision of the chief executive officer of the Western Health Board to refuse an application for a community pharmacy contractor agreement at Knock, County Mayo. The appeals are still under consideration at present and the Deputy will appreciate that it would not be appropriate for me to comment further on the matter at this stage.
