Written Answers - Disabled Drivers' Scheme.

Question:

107 Mr. Aylward asked the Minister for Finance if he will instruct the South-Eastern Health Board to review urgently an application under the disabled drivers and disabled passengers tax concession scheme by a person (details supplied) in County Kilkenny; and if he will make a statement on the matter. [11142/01]

It is a fundamental requirement for relief under the disabled drivers and disabled passengers scheme that the applicant must meet the medical criteria specified in the relevant regulations and be in possession of a primary medical certificate to that effect issued by the appropriate senior area medical officer, who is an official of the local health board. Where the issue of the primary medical certificate is refused, this may be appealed to the Disabled Drivers Medical Board of Appeal, an independent body whose decision is final. It should be noted that neither my Department nor the Revenue Commissioners has any role in the medical assessment of persons for the purposes of admission to the scheme.

In this case I understand that the person concerned was refused the issue of a primary medical certificate and that this refusal was appealed to the Medical Board of Appeal. I also understand that the Medical Board of Appeal will assess the person in due course and an appointment will be made in this regard as soon as possible.
