Vol. 534 No. 5

Written Answers - Children's Clothing.

Róisín Shortall

Question:

140 Ms Shortall asked the Minister for Health and Children if his attention has been drawn to reports that a retail outlet (details supplied) has recently sold a collection of clothing to fit children of 11-12-13 years which included an attached flavoured condom on the front of the clothing; his response to these reports; the action he intends to take on foot of these reports; and if he will make a statement on the matter. [11275/01]

I am not aware of the specific case to which the Deputy refers. Under the Health (Family Planning) Act, 1993, condoms are not classed as contraceptives for the purposes of the Act. While I consider the provision of condoms to persons of the ages indicated by the Deputy to be inappropriate, there is no legal impediment to their provision free of charge. Furthermore, the sale of condoms is not subject to regulation and I have no plans to make any regulations in this regard.
