Question:

152 Mr. Aylward asked the Minister for Agriculture, Food and Rural Development if he will review the claim for overpayment by his Department with regard to the EU suckler cow 2000 scheme of a person (details supplied) in County Kilkenny. [15222/01]

The person named applied on 30 animals under the 2000 suckler cow premium scheme. He received £4421.70 under this scheme and £136.20 under the 2000 suckler cow euro compensation scheme in respect of the 30 animals.

All applications received by my Department under the 2000 suckler cow premium scheme have now been cross-checked with the cattle movement monitoring system or CMMS. With regard to the application submitted by the person named this cross-check showed that ten animals were slaughtered within the six months retention period of the scheme and the person named did not notify my Department of the slaughter, nor of replacement animals, as he is required to do under the terms and conditions of the scheme. He was advised by letter of 24 April 2001 that these animals were now rejected and that in fact he had been overpaid a total of £4,557.90 under the scheme as no premium is payable where the rejected animals exceed 20% of the eligible animals. He was given the opportunity to have this decision reviewed by writing to my Department, within 14 days, with any additional information which may be of benefit to his case. To date no reply has been received from the person named.
