Question:

180 Mr. Sargent asked the Minister for the Environment and Local Government the person or group who is the first beneficiary of the extended exemption for electricity generators from requirements in the building regulations in relation to fire safety referred to in Circular Letter BC 17/2000 relating to the Building Regulations (Amendment) (No. 3) Regulations, 2000; and if he will supply copies of the undertaking referred to in that paragraph of the circular letter and copies of all correspondence, memoranda and other documents which led to the making of the amendment. The Building Regulations, 1997, under class 9, provided an exemption for the ESB. In the light of the deregulation of the electricity industry, amending regulations were made last year extending that exemption to all licensed private electricity supply utilities. The first known beneficiary of the extended exemption referred to by the Deputy is Dungarvan Energy Limited. I am arranging to have copies of the papers referred to sent to the Deputy.
