Question:

422 Mr. Ring asked the Minister for Social, Community and Family Affairs if a person (details supplied) in County Mayo will be granted an old age non-contributory pension. [16713/01]

The person concerned applied for an old age non-contributory pension in March 2001. His application has been refused as his weekly means, derived mainly from his spouse's net earnings, exceeded the statutory limit.

The person concerned has been informed of his right of appeal to the social welfare appeals office if he is dissatisfied with the outcome.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
