Question:

204 Mr. McGuinness asked the Minister for Justice, Equality and Law Reform if he will re-examine the case of a person (details supplied) who was refused entry and grant her an opportunity to appeal her case; if, in view of her medical circumstances, he will consider over-ruling the decision in her case and dealing with the issue as a matter of urgency. The person referred to arrived in the State on 18 December 2000 and sought asylum. Following an interview, her case was deemed manifestly unfounded on 8 March 2001. Her subsequent appeal was refused by the Appeals Authority on 19 April 2001.

In accordance with section 3 of the Immigration Act, 1999, the person in question was informed on 1 June 2001 that it was proposed to make a deportation order in respect of her. She was given the alternatives of either making representations within 15 working days setting out reasons why she should be allowed to remain temporarily in the State, leaving the State before the order was made or consenting to the making of a deportation order. Her reply is still awaited at present and I expect the file to be submitted to me for consideration shortly.
