Question:

99 Mr. O'Shea asked the Tánaiste and Minister for Enterprise, Trade and Employment if she has received an indication from the Health and Safety Authority as to the enforcement action it plans to take arising from its investigation into the death of a man in an industrial action at the premises of a company (details supplied) in January 2001; and if she will make a statement on the matter. The national authority for occupational safety and health, known as the Health and Safety Authority, is the State body with responsibility for the administration, monitoring and enforcement of occupational health and safety legislation. The carrying out of inspections and investigations is a day-to-day matter for the authority, as is the taking of enforcement action. I have no statutory function in this regard, and it would be inappropriate for me to comment on what enforcement action the authority may or may not consider in any specific case, as this could prejudice subsequent action which might ensue.

I have, however, been informed by the authority that it is in continuous contact with the company in question regarding the implementation of safety management procedures within the company.
