Vol. 538 No. 3

Written Answers. - Army Disability Pension.

Ned O'Keeffe

Question:

140 Mr. N. O'Keeffe asked the Minister for Defence the position regarding an application for an army disability pension by a person (details supplied) in County Cork. [18043/01]

The person in question has been found eligible for a disablement gratuity under the Army pensions Acts. He has also received compensation in settlement of a civil action against this Department for the same disablement. In this regard, the Army pensions Acts provide that alternative compensation received may be taken into consideration in fixing the level, if any, of disablement gratuity. The question of whether all or some of the compensation received by him should be taken into account is under consideration. The matter will be decided as quickly as possible at which stage the individual will be informed of the outcome.
