Question:

171 Mr. Ring asked the Minister for Social, Community and Family Affairs when he will finalise an unemployment benefit appeal by a person (details supplied) in County Mayo. [19494/01]

The person's claim for unemployment benefit was disallowed by a deciding officer on the grounds that he did not satisfy the statutory condition of genuinely seeking work.

His appeal against this decision to the social welfare appeals office has been considered by an appeals officer who has decided that an oral hearing is necessary. It is not possible to give a precise date for this oral hearing but it will be arranged as soon as possible.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
